1. About these terms

These Terms & Conditions govern your use of HypeData ("HypeData", "we", "us", "our"), a digital services product that lets users in Nigeria buy airtime and mobile data and pay for supported bill services such as cable TV and electricity, funded through a prepaid wallet.

HypeData is currently operated as a startup product. We make no claim of company registration, licensing or regulatory approval that we do not hold. These terms will be updated with registered entity details once such registration is completed.

By creating an account or using HypeData, you agree to these terms. If you do not agree, please do not use the service.

2. Account registration

  • You must be at least 18 years old and legally able to enter into a contract.
  • You must provide accurate details, including a valid email address and phone number.
  • One person should maintain one account, used personally and not on behalf of others without authorisation.
  • We may require verification of your details before enabling or continuing certain features.

3. Your responsibilities

  • You are responsible for the accuracy of every detail you enter — phone number, network, bundle, meter number, meter type, smartcard number and amount.
  • Transactions submitted to a network or biller with correct-but-unintended details (for example a top-up sent to the wrong phone number you typed) generally cannot be reversed. Always confirm the details on the review screen before authorising.
  • You must keep your login credentials, transaction PIN and device secure.
  • You must not use HypeData for any unlawful purpose.

4. Wallet funding

HypeData operates a prepaid wallet. You fund the wallet through our payment processor, and your balance is credited once the payment is confirmed as successful. Your wallet is a balance for purchasing services on HypeData; it is not a bank account and does not earn interest.

A funding fee may apply and, where it does, it is shown before you confirm the payment. Funding times depend on your bank and the payment processor; delays outside our control can occur. If a payment is debited from you but not credited to your wallet, contact support with the payment reference so it can be traced and reconciled.

5. Airtime and data purchases

Airtime and data purchases are fulfilled through upstream telecom and VTU providers. The amount is debited from your wallet when you authorise the transaction with your PIN. We aim to deliver purchases promptly, but we do not guarantee a specific delivery time, because fulfilment depends on the network operator and upstream provider.

Data bundle validity, coverage and terms are set by the network operator, not by HypeData.

6. Electricity, cable TV and other bill services

Bill services are processed through our bill payment provider and the relevant biller (for example a distribution company or pay-TV operator). Before payment you may be asked to verify a meter or smartcard number; the customer name shown is returned by the biller and you should confirm it is correct before continuing.

Minimum and maximum amounts, meter types and service availability are set by the biller and may change without notice. Electricity tokens are generated by the biller; where a token is delayed or not returned immediately, the transaction remains under processing until the provider confirms its final status.

7. Transaction processing and pending transactions

A transaction moves through defined states: pending while it is with the provider, success once the provider confirms delivery, and failed if the provider rejects or cannot complete it. Where a provider reports a confirmed transaction back as still processing, HypeData may show it as under review while we continue to check its final status with the provider.

Some transactions remain pending for a period while awaiting provider confirmation. A pending transaction is neither a confirmed success nor a confirmed failure, and we do not guarantee completion within any specific timeframe.

8. Refunds and failed transactions

If a purchase is rejected or confirmed failed by the provider, the amount debited is returned to your HypeData wallet. Refunds are credited to your wallet balance, not to your bank or card, unless we specifically agree otherwise.

We do not offer refunds for successfully delivered transactions, including where you entered a valid but incorrect phone number, meter number or smartcard number. Where a transaction is disputed, we will investigate with the relevant provider and act on the outcome of that investigation, which may take time. Not every transaction can be reversed.

9. Pricing and fees

Prices for airtime, data bundles and bill services are displayed in the app before you confirm, and any applicable fee or discount is included in the amount shown. Prices are set by HypeData based on provider rates and may change at any time without prior notice. The price shown at the time you confirm is the price that applies to that transaction.

10. Prohibited and fraudulent use

You must not:

  • Use HypeData for fraud, money laundering, or any illegal activity.
  • Use stolen, unauthorised or disputed payment instruments to fund a wallet.
  • Attempt to exploit pricing errors, refund flows, referral rewards or system faults.
  • Attempt to gain unauthorised access, probe, overload, scrape or reverse-engineer the service.
  • Create multiple accounts to abuse promotions or evade a suspension.
  • Resell or automate access in a way that disrupts the service or other users.

We may suspend accounts, withhold or reverse balances obtained through abuse, and report suspected fraud to the relevant authorities and providers.

11. Account security and PIN

Your transaction PIN authorises payments from your wallet. You are responsible for keeping it, your password and your device secure, and for all activity carried out with your credentials. Never share your PIN, password or one-time codes with anyone — HypeData staff will never ask you for them.

If you suspect unauthorised access, change your password and PIN immediately and contact support. We are not liable for losses arising from your failure to keep your credentials secure.

12. Service availability

We aim to keep HypeData available at all times, but the service is provided on an "as is" and "as available" basis. Access may be interrupted by maintenance, upgrades, network or biller downtime, or events outside our control. Individual services may be placed in maintenance mode or withdrawn temporarily without prior notice.

13. Third-party providers

HypeData relies on third parties, including a payment processor, a bill payment provider, upstream telecom/VTU providers, network operators and billers. Their systems, pricing, downtime and processing times are outside our control. Where a third party delays, rejects or fails a transaction, our responsibility is limited to processing the outcome correctly on your account, including refunding your wallet where the transaction is confirmed failed.

14. Limitation of liability

To the extent permitted by law, HypeData is not liable for indirect or consequential losses, loss of profit, loss of data, or losses caused by third-party providers, network downtime, or details you entered incorrectly. Where we are found liable in connection with a transaction, our liability is limited to the value of that transaction. Nothing in these terms excludes liability that cannot lawfully be excluded, including for fraud on our part.

15. Suspension and termination

We may suspend or close an account where we reasonably suspect fraud or abuse, where required by law or by a provider, or where these terms are breached. You may stop using HypeData at any time and request account closure through support. Where an account is closed, any legitimate remaining wallet balance will be made available to you, subject to verification and to any pending investigation.

16. Changes to the service and these terms

We may add, change or remove features, providers and supported services, and we may update these terms as the service evolves. The "Last updated" date reflects the current version, and continued use after an update means you accept the revised terms.

17. Disputes and support

If something goes wrong, contact support first with your transaction reference so we can investigate with the relevant provider. Most issues are resolved this way. These terms are governed by the laws of the Federal Republic of Nigeria, and any dispute that cannot be resolved through support will be subject to the jurisdiction of the Nigerian courts.
